As a partner with Coleman & Chambers, LLP, in Gainesville, Georgia, Cale Rogers assists our clients in the areas of  Bankruptcy, the drafting, reviewing and negotiation of contracts, and the preparation of Wills and Trusts.  Cale also regularly represents clients in Probate Court in connection with both disputed and undisputed claims, conducts Real Estate Closings and handles Real Estate Litigation and general Civil Litigation, and represents business clients in a variety of matters, including negotiating business transactions and contracts and handling business disputes that result in litigation.

Cale understands that filing for bankruptcy is a decision that should be made only after adequate consideration. Cale regularly represents debtors and creditors in bankruptcy court, and is familiar with bankruptcy procedures, including the means test, reaffirmation of debt and lien avoidance. Cale can assist you in getting a fresh start in Chapter 7 or Chapter 13 filing, if you qualify based on your income and financial condition. Many Chapter 7 and Chapter 13 debtors can keep their home and car and still qualify for bankruptcy.

Cale also frequently practices in the local probate courts. Whether you are filing a simple will for probate, or whether you are involved in a contested estate or want to challenge or caveat a will that has been filed for probate, Cale can represent you in probate court in any county in North Georgia. He is familiar with Year's Support statute and how the same can be used to avoid certain claims of creditors.  Once probate has been completed, Cale can assist you with running the required notice to creditors, administering the estate, obtaining the tax id number from the IRS, transferring the assets to the heirs or beneficiaries and dealing with the claims of creditors. Cale also provides estate planning and asset protection advice to clients, and prepares wills, trusts and powers of attorney for clients to help them implement their wishes concerning the disposition of property.

As the supervising real estate lawyer in our Gainesville, Georgia office, Cale ensures that our clients' needs are met when either purchasing or selling residential or commercial property. With more than eight years experience as a closing attorney, and with significant experience evaluating, examining and searching real estate records and titles, Cale is familar with the procedures and formalities to ensure that a closing goes smoothly. Cale has experience litigating real estate related disputes, and has successfully resolved various real estate cases that resulted in litigation, including boundary line disputes, easement disputes, quiet title actions related to the lawful ownership of property, title insurance claims, eminent domain (condemnation) cases, and disputes related to real estate purchase and sale agreements.

Cale also handles a significant amount of the firm's Business, Corporate and Contract work.  When drafting and interpreting legal contracts, it is important to have an attorney who is familar with the relevant legal principles to analyze the specific provisions of the contract and tailor them for the benefit of the client in the event that a dispute arises.  Cale also helps our clients prepare, interpret and negotiate conntracts, including real estate contracts and all variety of business-related contracts, including asset purchase agreements, employment agreements, and contracts containing restrictive covenants, and if necessary, represents our clients in court if a contract dispute results in litigation.  Additionally, Cale assists our business clients with incorporation and formation of companies, LLC's and partnerships, and provides business representation on a continuing basis to help our business clients understand and comply with the legal formalities of operating a company.  For those clients who want to offer their company's securities (or the securities of a start-up company) to a limited group of investors, Cale can counsel you on the requirements of Regulation D filings and private (or limited) offerings of securities under Georgia and Federal law.

Cale also handles domestic matters and assists other domestic attorneys with the preparation and review of prenuptial agreements and Qualified Domestic Relations Orders (QDROs), which are often required when a proeprty settlement in a divorce contemplates the division of one or more retirement accounts.
