Many things can change after a divorce is final. Does the judgment need to be modified to meet those changes? What factors does the Court consider in determining whether to modify child support or alimony ? Talk to an experienced family law attorney regarding your modification of child support or modification of alimony matter.
ADR/Mediation
Many Courts have gone to mandatory mediation in domestic relations matters. Mediation can often be a cost saving method of resolving complex divorce, child custody and contempt and other domestic cases.
Alimony and Spousal Support
The Judge or Jury can consider numerous factors in determining whether alimony should be awarded, including but not limited to:
- Duration of the marriage
- Causes of separation
- Standard of living
- Financial resources
- If applicable, time necessary to obtain education and training for employment
- Contributions, including homemaking, childcare, education, and career building
- Condition of the parties, including separate estate, earning capacity and fixed liabilities
- Such other factors as are equitable and proper
At Coleman, Chambers & Rogers, LLP we will discuss each of these factors with you to determine if alimony is appropriate in your case.
Legitimation and Paternity
- Were the parents married at the time the child was conceived?
- Did the parents marry subsequent to the birth of the child?
We can assist you in establishing or denying the parentage of a child.
Pre-Nuptial and Post-Nuptial Agreement
Many people are getting married later in life; and therefore, they have accumulated significant property. We review and draft pre-nuptial and post-nuptial agreements on a regular basis.
