Civil Litigation
Civil litigation is often a stressful, frustrating process. Let’s face it, there’s often a lot of money at stake in a civil case. Some might argue that, other than the underlying facts of a particular case, the attorneys who participate in the case have the most effect on the ultimate outcome of the case. That’s why it’s important to choose an experienced trial lawyer who understands the intricacies of civil practice that can help you prosecute or defend your civil case. Our civil trial lawyers have handled civil claims in Gainesville and throughout Georgia. We know what it takes to prepare and present complex civil cases, and have a proven track record of successful results.
Many civil cases are the result of a breach of contract or a tort, like fraud, negligence or trespass. In one recent case, we obtained a seven-figure verdict in a jury trial in favor of aggrieved property owners against the neighboring landowner for nuisance and trespass, and successfully defended the appeal that resulted in the verdict being upheld. In another recent multiparty civil case, we prosecuted a wrongful death claim on behalf of a widow after her husband was killed by a drunk driver. The case involved multiple claims, including allegations that the driver’s employer negligently entrusted the automobile involved in the accident to an alcoholic. In prosecuting that case, we conducted more than 40 depositions, prosecuted or defended more than 10 motions for summary judgment, and successfully defended an ancillary suit for declaratory judgment that one of the defendants filed in federal court in an attempt to resolve some of our claims in an unfavorable venue. After more than three years of prosecuting the claim on behalf of our client, we obtained a favorable settlement from the four insurance companies involved.
There are many different types of civil litigation. In a real estate litigation case, for example, the issue for determination by the court is often the true ownership of a parcel of disputed property, the existence or nonexistence of an easement asserted by a nearby property owner, or the location of the boundary line dividing two adjacent parcels of real estate.
